The Cabinet of Ministers of Ukraine has amended the rules governing compensation for losses incurred by water users. The new measures will enable businesses to more effectively compensate for losses they have suffered due to the termination or modification of special water use conditions.
This was reported by the Ministry of Economy, Environment, and Agriculture of Ukraine.
New opportunities for protecting rights
Under the new provisions, if the actions of one water user restrict water use by another, the affected party may contact the State Environmental Inspection of Ukraine or law enforcement agencies to document the violation. Damages will be calculated according to an approved methodology, after which the affected party may file a lawsuit to seek compensation.
Uniform and transparent rules
Damages will be calculated using a methodology approved by the Ministry of Economy. This will ensure uniform and transparent rules for all participants in the process. “We are making the rules regarding water use more understandable and fair,” noted Deputy Minister Iryna Ovcharenko.
Previously, the procedure for compensating damages was based on the conclusions of an environmental assessment under a law that is no longer in effect.
